Notices to you may be sent via email to your registered address or posted on the Website.

10. Assignment

You may not assign these Terms without Bubbot's consent. Bubbot may assign to affiliates without notice.

11. Waiver

Failure to enforce any right does not waive it.

If any provision is unenforceable, it shall be modified to reflect the original intent without affecting other provisions.

13. Entire Agreement

These Terms constitute the full agreement regarding use of the Website and supersede prior communications.

14. Governing Law & Dispute Resolution

General Rule (non-EU consumers)

These Terms are governed by the laws of Delaware, USA, excluding conflict-of-law rules. Disputes shall be resolved by binding arbitration under JAMS rules in Delaware, conducted in English.

  • Class Action Waiver: All claims must be brought individually.
  • Jury Trial Waiver: YOU WAIVE ANY RIGHT TO JURY TRIAL.
  • Opt-Out Right: You may opt out of arbitration within 30 days of accepting these Terms by emailing bubbotofficial@gmail.com with your full name, address, phone number, account info, and a statement electing to opt out.

EU Consumers Special Terms

If you are a resident of the European Union:

  • These Terms shall be governed by the consumer protection laws of your country of residence;
  • You may bring disputes before the courts or competent consumer dispute bodies in your country of residence;
  • Nothing in this clause limits your EU statutory rights.

US State-Specific Terms

  • California Residents: Arbitration may be conducted at a JAMS branch located in your county of residence. If the class action waiver is deemed invalid, the rest of this arbitration clause remains enforceable. This arbitration clause is presented in bold and clear format in compliance with California law.
  • New York Residents: This arbitration clause is displayed in a clear and prominent manner in accordance with New York General Business Law.
